General Terms and Conditions

These General Terms and Conditions apply to any and all use of this website (www.lenahoschek.com). The business dealings between Lena Hoschek GmbH and the consumer (Section 1 Austrian Consumer Protection Act, Konsumentenschutzgesetz, KSchG) are governed exclusively by these General Terms and Conditions in the version valid at the time of the placement of the order, unless otherwise agreed. Deviating conditions of the customer are not accepted, unless Lena Hoschek GmbH expressly agrees to the application of other conditions.


1. Scope

1.1. All deliveries from Lena Hoschek GmbH (hereinafter: LENA HOSCHEK) to consumers (section 1 KSchG) are governed by these General Terms and Conditions (GTCs).

1.2. Consumers are consumers as defined in the Austrian Consumer Protection Act (KSchG), namely natural or legal persons who are not entrepreneurs. An entrepreneur is someone for whom the transaction is effected in the course of the operation of a business. A business is any permanent organization of an independent economic activity, even if it is not profit-oriented. Legal persons governed by public law are always deemed to be entrepreneurs.

3. Offer and Conclusion of Contract
3.1. The depitction of the products in our online shop does not constitute a legally binding offer, but an invitation to order. Errors excepted.

3.2. By clicking on the "Order with obligation to pay" button, you submit a binding order of the products listed on the order page. The purchase contract is concluded when we accept your order by an order confirmation via e-mail, issued directly after receiving your order.


4. Right of Withdrawal and Cancellation Policy
4.1. Consumers have a fourteen-day grace period.

Cancellation Policy

Cancellation Right

You have the right to withdraw from this contract within fourteen days without specifying any reasons.

The cancellation period is fourteen days from the day upon which you, or a third party designated by you, other than the carrier, take(s) possession of the goods. .

To exercise your cancellation right, please notify us (LENA HOSCHEK GmbH, Längenfeldgasse 27/6A Stiege B, 1120 Vienna/Austria, Tel.: +43 (0) 50 309 400, e-mail: onlineshop@lenahoschek.com) in an unequivocal statement (e.g. a letter sent by mail or email) of your decision to cancel this agreement.

For the purposes of compliance with the cancellation deadline, it is sufficient if you notify us that you are exercising your cancellation right before the cancellation period has expired.

Consequences of Cancellation

If you cancel this contract, we shall refund all payments received from you, including shipping charges (except for additional costs incurred if you chose a method of shipping other than the most cost-efficient standard delivery offered by us) without delay but no later than fourteen days from the day on which we received the notice of cancellation. Repayment will be made using the same payment method used for the original transaction, unless otherwise explicitly agreed with you; under no circumstances will you be charged any fees for this repayment. We may withhold the refund until the items have been returned to us, or until you have provided evidence that you have shipped the goods, whichever is earlier.

You must send back or return the goods to us without delay, no later than fourteen days from the day on which you notified us of the cancellation of this contract. The deadline will be deemed to have been observed if you send the items before the fourteen-day deadline has expired.

LENA HOSCHEK shall bear the costs of returning the goods from Germany and Austria, provided you return the goods using the GLS returns label provided by LENA HOSCHEK. The returns label is included in the shipment of the ordered goods. Otherwise, you will bear the direct cost of returning the goods. You will be required to pay any extra costs incurred by you choosing to have the goods collected. You shall bear the direct cost of returning the goods from Switzerland, non-EU member states and third countries.

You will be liable for any potential reduction in value of the items only if this reduction in value is due to handling on your part which was not necessary for testing the quality, characteristics, and functioning of the items.

Lapse of Cancellation Right

The cancellation right does not apply to goods made according to customer specifications; which are clearly tailored to personal needs; which by their very nature are not suitable for a return; which can quickly decay or where the expiry date has been exceeded (Section 18(1) Austrian Distance Selling Act (Fern- und Auswärtsgeschäfte-Gesetz, FAGG)

5. Prices
5.1. The prices stated on the product pages are gross sales prices and include value added tax at the applicable statutory rate and other price components, but do not include shipping costs. For shipping costs, please refer to clause 6 of these GTCs.

5.2. Gift Cards / Gift Vouchers. The following provisions apply to the sale of LENA HOSCHEK gift cards / gift vouchers:

5.2.1. Gift vouchers are valid for 12 months from purchase.

5.2.2. Gift certificates are non-transferable and cannot be returned or paid out.

5.2.3. If the total value of your order is below the value of the gift card, the residual amount shall be issued in the form of a new gift voucher.

5.2.4. If you return items you have paid for using a gift voucher, the amount to be refunded will be issued and sent to you in the form of a new gift card.

5.2.5. LENA HOSCHEK assumes no responsibility for gift cards and vouchers that are lost, stolen, destroyed or redeemed without authorization.

5.2.6. Discount codes cannot be used when purchasing gift vouchers.

5.2.7. Gift vouchers cannot be used in combination with other discount codes.

5.2.8. All items purchased using a LENA HOSCHEK gift voucher are subject to standard tax and shipping.

5.2.9. The standard shipping charges apply when shipping gift vouchers. For shipping costs, please refer to clause 6 of these GTCs.

Please note that for shipping to non-EU countries, any import VAT and customs charges must be borne by the customer. LENA HOSCHEK is not able to estimate the amount of such costs. For further information, please contact the competent customs authority.

6.1. Returns
If you exercise your cancellation right and return the goods to LENA HOSCHEK, LENA HOSCHEK shall bears the cost of return within Austria and Germany, provided the LENA HOSCHEK returns label is used.

The customer shall bear the costs for the return shipment of all orders outside Austria and Germany. Any customs charges for delivery and return from non-EU countries shall not be borne by LENA HOSCHEK.

LENA HOSCHEK kindly requests that customers always use the original packaging when returning goods. However, use of the original packaging is not obligatory and does not affect the customer's statutory rights.

LENA HOSCHEK points out that perfume can be returned only unused and in the original packaging. LENA HOSCHEK recommends that you request a fragrance sample before purchasing.

6.2. Exchanges
The goods purchased from LENA HOSCHEK are excluded from exchange. If your ordered item does not fit and you wish to exchange for a different size or colour, LENA HOSCHEK requests that you place a new order for the products concerned.

7.2. Delivery is subject to availability. Delivery time within Austria is up to 3 working days, deviations in delivery times possible.

7.3. When paying by advance payment, delivery will be made only upon receipt of full payment on the LENA HOSCHEK bank account stipulated in clause 9.1.


8. Transport Damage
If the customer establishes transport damages to the delivered goods/packaging upon delivery, the customer is requested to have the employee of the carrier confirm such damage, in writing, and to notify LENA HOSCHEK accordingly.
Failure to obtain written confirmation has no consequences for the statutory warranty rights of the customer. Written confirmation from the carrier serves the assertion of the claim by LENA HOSCHEK against the carrier or transport insurance. If the customer takes photographs of the damage, LENA HOSCHEK kindly requests that it forward such photographs to LENA HOSCHEK.

9. Payment
The customer has the following payment options:

9.1. Advance Payment by Bank Transfer
In the payment section, select 'Payment type' "Advance Payment by Bank Transfer" to complete the order.
You will receive the bank details for LENA HOSCHEK and the order number in an automatically generated e-mail order confirmation.

Please transfer the total amount within 5 workingdays due to the following account, quoting your order number:

Any transfer costs and bank charges shall be borne by the customer. LENA HOSCHEK will ship your order once the payment is credited to the LENA HOSCHEK account. Credit amounts resulting from returns shall be reimbursed to the bank account from which the original payment was made.

9.2. Payment via PayPal
PayPal is the online payment service that allows you to pay securely, easily and quickly in online shops. PayPal is based on the payment methods you know from your bank. For each transaction, the customer decides whether they would like to pay by bank transfer, direct debit, using PayPal account credit or by credit card. Regardless of which payment method is chosen, there are no additional fees. LENA HOSCHEK's PayPal payment address is: onlineshop@lenahoschek.com


10. Retention of Title
Goods remain the property of LENA HOSCHEK until payment has been received in full.


11. Warranty and Liability
If the purchase item is defective, the customer can choose subsequent performance in the form of the rectification of defects or the supply of a new, defect-free item.

If the supplementary performance fails twice, or the customer unsuccessfully set a reasonable period for subsequent performance, the customer is entitled to demand withdrawal (conversion) or reduction in price at his discretion.

The limitation period is two years from delivery of the goods.

12. Image rights
All image rights belong to LENA HOSCHEK. Even partial use of images is not permitted without the consent of LENA HOSCHEK.


13. Final Provisions
13.1. This contract shall be governed by and construed in accordance with Austrian law, but only insofar as the protection granted the customer is not precluded by mandatory provisions under the law of the state in which the customer is resident.

13.2. The customer can choose between the court at their place of residence and the seat of Lena Hoschek GmbH to rule on any and all disputes arising directly or indirectly under this contract.

13.3. To the extent legally permissible, the place of performance and the place of jurisdiction for deliveries and payments and for all disputes arising between the parties, shall be Vienna. For consumers, the place of performance and legal jurisdiction are at the seat of the purchaser. If the private consumer is not domiciled within the European Union, the place of jurisdiction shall be Vienna. For transactions with customers within the European Union, the mandatory consumer protections laws of the customer's place of residence may also apply.

13.4. Should any provision of this agreement with the consumer, including these General Terms and Conditions, be or become invalid, in full or in part, this shall not affect the validity of the remainder of the provisions.


Additional Information

Order process
The customer can place one or more items into the virtual shopping basket on the pages upon which the goods concerned are displayed in the online shop by clicking on the "add to basket" button or on a corresponding symbol. After placing all the desired items in the basket, the customer can proceed to the order process by clicking "Checkout" or the corresponding symbol.

Both registered customers and guests can place orders. In the next step of the order process, the customer can register by entering their personal information or go to checkout as a guest without creating an account. In this step, registered customers can login using their login information by clicking the “login” button. The customer data is transmitted in encrypted form.

In the next step, the customer can also select his desired payment method: advance payment, payment by immediate transfer, PayPal or credit card.

In the next step of the order process, an overview of the selected products in the basket is displayed. Before placing a binding order, the customer can review the number and type of goods selected and correct if necessary. Individual items and other order data can be accessed and changed by clicking on the "edit basket" button or using the standard browser functions. In this step, the customer confirms that they have read and agree to these General Terms and Conditions by clicking on the relevant box.

At the bottom of the page, the customer submits all data and places the binding purchase offer by clicking the "Order with obligation to pay" button. This opens an order confirmation page.


Contract Text
The contract will be filed by LENA HOSCHEK and sent by e-mail to the customer together with the order data. The contract will be provided in German and English. On completion of the order, your order data is no longer available via the Internet for security reasons. Registered customers can view previous orders in the secure customer area.
